Tamara McIntosh Design & Communications is committed to providing visitors with a website that respects their privacy. This page summarizes the privacy policy and practices on the Site. Tamara McIntosh Design & Communications does not automatically gather any specific personal information from you, such as your name, IP number, e-mail address, etc. We would only obtain this type of information if you supply it by sending us an e-mail. If you send us an e-mail we will only collect your personal information for the purpose of responding to you and for such other purposes to which you explicitly consent. Tamara McIntosh Design & Communications employs software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. This software receives and records the Internet Protocol (IP) address of the computer that has contacted our website, the date and time of the visit and the pages visited. We do not attempt to link these addresses with the identity of individuals visiting our site unless an attempt to damage the site has been detected. Tamara McIntosh Design & Communications does not use cookies except as stated herein (A “cookie” is a small file that may be placed on your computer without your knowledge by a website to allow it to monitor your use of the site). TM Design & Communications will not collect any specific and identifiable personal information from your computer.

Severability 

In the event that any part of a provision(s) of the Terms and Conditions set out in this Legal Notice is (are) held to be invalid, unenforceable, or void, such provision(s) shall, by the adjudicating body, be applied to the fullest extent possible and shall be read-down only to the extent absolutely necessary to comply with applicable law. If any provision(s) of the Terms and Conditions set out in this Legal Notice is (are) held to be invalid, unenforceable, or void, such provision(s) shall be severed from the Legal Notice. The fact that part of a provision(s) or an entire provision(s) has (have) been held to be invalid, unenforceable, or void such determination shall not affect the validity and enforceability of any other remaining provisions.

Jurisdiction

The Site is physically maintained and operated by Tamara McIntosh Design & Communications within the Province of Ontario, Canada. This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein and should be treated as an Ontario contract without reference to the principals of conflicts of law. All disputes arising from or in connection with the Site shall be subject to the jurisdiction of the courts of the Ontario. You agree to the exclusive jurisdiction of the courts of the Province of Ontario to finally adjudicate any legal proceeding arising out of or in connection with the Site. Any disputes shall be submitted to the non-exclusive jurisdiction of the Courts of Ontario, Canada.
